Refund & Cancellation Policy

Version 1.1

This is the Nabla Refund and Cancellation Policy version 1.1, rendered 1:1 from the REFUNDS.txt file shipped with the Software. This version is also published permanently at refunds-1.1.html and will never be overwritten once superseded - see the version note in the document itself.

                NABLA REFUND AND CANCELLATION POLICY
================================================================================

Nabla - 2D Finite Element Method (FEM) software for electromagnetic and
thermal field simulation.

Published by Pontus Materials, a sole trader business carried on by
Inga Tuzovskaya, of 23 Palmers, Wantage, Oxfordshire, OX12 7HA, United Kingdom,
trading as "Nabla".

Policy version 1.1
Last updated: 8 August 2026

This policy explains when you can get your money back, how to ask, and how to
stop a subscription.

It forms part of the Nabla End User License Agreement (LICENSE.txt, referred to
below as "the License Agreement"); see its clause 8.

--------------------------------------------------------------------------------
C1. WHO YOU ARE DEALING WITH
--------------------------------------------------------------------------------

C1.1 Our order process is conducted by our online reseller Paddle.com.
Paddle.com is the Merchant of Record for all our orders. Paddle provides
all customer service inquiries and handles returns.

C1.2 In practice that means Paddle takes the payment, issues the invoice, and
pays the refund. We supply the Software and the license.

C1.3 You can ask either of us. If you write to us at info@nabla-fem.com we
will pass a refund request to Paddle and follow it up. Going to Paddle
directly - through the link in your receipt email, or at
     https://paddle.net - is usually faster.

--------------------------------------------------------------------------------
C2. TRY IT BEFORE YOU BUY
--------------------------------------------------------------------------------

C2.1 Nabla has a permanently free tier. It runs real simulations, up to a
25,000-node mesh, with no time limit and no account. It exists so that you
can find out whether the Software suits you before spending anything.

C2.2 Academic users can apply for a free license covering every module
     (License Agreement, clause 3.4).

C2.3 We would always rather you evaluated first than bought and asked for the
money back. But if you did buy and it was wrong, C3 applies.

--------------------------------------------------------------------------------
C3. THE 14-DAY REFUND
--------------------------------------------------------------------------------

C3.1 You may ask for a full refund within 14 days of:

     (a) buying a license; or
     (b) the date on which a subscription last renewed.

C3.2 Within that window we do not ask for a reason and do not require you to
justify the request. This mirrors the refund right the Paddle Buyer Terms
already give you, so that there is one rule and not two.

C3.3 On refund, the license ends. Your models and results remain yours and
remain openable: the Software reverts to the Free Tier or the Viewer state,
and never locks a file you created (License Agreement, clause 3.7).

--------------------------------------------------------------------------------
C4. YOUR STATUTORY RIGHTS AS A CONSUMER
--------------------------------------------------------------------------------

C4.1 If you bought as a consumer rather than for your business, you have a legal
right to cancel a distance contract within 14 days under the Consumer
Contracts (Information, Cancellation and Additional Charges) Regulations
     2013.

C4.2 Because Nabla is digital content that is supplied immediately, you lose
that cancellation right once supply begins - but only if you expressly
agreed to immediate supply and acknowledged losing the right. The checkout
asks you to confirm both before taking payment. If it did not, or you did
not agree, the 14-day right stands.

C4.3 Separately, if the Software is faulty, not as described, or not of
satisfactory quality, the Consumer Rights Act 2015 gives you the right to a
repair, a replacement or a price reduction, and in some cases a refund.
Nothing in this policy or in the Agreement limits that.

C4.4 Note the difference between a fault and a modelling outcome: Nabla computes
approximate numerical solutions, and a result that is wrong because of the
geometry, materials, mesh or assumptions you chose is not a defect in the
     Software (License Agreement, clause 16).

--------------------------------------------------------------------------------
C5. SUBSCRIPTIONS: CANCELLING AND RENEWING
--------------------------------------------------------------------------------

C5.1 Subscriptions renew automatically at the end of each term until cancelled.
The renewal date is on your receipt and in the Software under
     Help > About.

C5.2 Cancel at any time through the link in your Paddle receipt email, or by
emailing us and asking us to do it.

C5.3 Cancelling stops the next renewal. It does not shorten the term you have
already paid for: your license keeps working until the end of that term,
and then the Software reverts to the Free Tier or the Viewer state.

C5.4 Cancelling part-way through a paid term does not by itself produce a refund
of that term, except under C3, C4, C6 or C7.

C5.5 If a renewal payment fails, no new License Token is issued and the license
lapses at the end of the term it has already been paid for. There is
nothing to refund and no debt collection.

--------------------------------------------------------------------------------
C6. IF WE WITHDRAW SOMETHING YOU PAID FOR
--------------------------------------------------------------------------------

C6.1 If we discontinue a Module that your current paid Entitlement includes, we
will either keep the last build in which it worked available to you, or
refund a fair proportion of the fee for the unexpired part of your term
     (License Agreement, clause 6.5).

C6.2 If we terminate your license for our own convenience, we refund the
unexpired part of the term pro rata (License Agreement, clause 20.6).

C6.3 Neither applies where we terminate for a breach of the Agreement by you.

--------------------------------------------------------------------------------
C7. WHAT WE WILL LOOK AT OUTSIDE THE WINDOW
--------------------------------------------------------------------------------

C7.1 Outside the 14 days we consider requests case by case, and we do grant
them - typically where a license was bought twice, bought for the wrong
edition, bought by someone who then could not install it, or renewed by a
customer who had meant to cancel and had not used it since.

C7.2 A refund granted in one case does not commit us to granting another.

--------------------------------------------------------------------------------
C8. WHAT IS NOT REFUNDABLE
--------------------------------------------------------------------------------

C8.1 An Academic License and the Free Tier: nothing is paid for them.

C8.2 A license terminated for a material breach of the Agreement, in particular
for tampering with the licensing mechanism or for using a free or academic
license commercially (License Agreement, clauses 9.1(e) and 9.1(g)).

C8.3 Nothing in C8 limits the rights in C4.

--------------------------------------------------------------------------------
C9. HOW TO ASK, AND HOW LONG IT TAKES
--------------------------------------------------------------------------------

C9.1 Use the link in your Paddle receipt, write to Paddle at
https://paddle.net, or email us at info@nabla-fem.com with your order
reference or the email address you bought with.

C9.2 We aim to answer within two working days. Paddle normally processes an
approved refund within a few working days, after which your bank or card
issuer decides how quickly it appears - usually 5 to 10 working days.

C9.3 The refund goes back to the payment method you used. Paddle refunds in the
     currency you were charged.

C9.4 Please ask before raising a chargeback with your bank. A chargeback costs
us a fee and takes months; an email usually takes a day, and the answer is
     nearly always yes.
